Industrial property rights in general represent exclusive rights which prevents a third party from using the subject-matter of the industrial property right without authorization. If the subject-matter of the industrial property right nevertheless is used, the industrial property right is infringed. In this case the owner may bar the infringer from a further use and may assert claims for indemnification or damage compensation.
